AGC must ‘do the right thing’ to drop Najib’s charges following leak of documents, says daughter
PETALING JAYA: Nooryana Najwa Najib wants the Attorney-General Chambers (AGC) to drop all the six corruption charges in 2019 against her father Datuk Seri Najib Razak and former Treasury secretary-general Tan Sri Mohd Irwan Serigar Abdullah.
She said the AGC must “do the right thing” and immediately drop the charges following the alleged leak of documents from a prosecutor, recommending to the then attorney general Tan Sri Tommy Thomas to drop the charges against the two.
“The 12-page internal memo goes into great detail of why there was no merit to the case and that my father and Irwan did not commit any wrongdoings over the IPIC settlement.
“What was revealed in the leaked memo is indeed shocking,” she said in a Facebook post on Friday (Aug 18).
On Aug 17, Attorney General Tan Sri Idrus Harun told The Star that the AGC was investigating the matter.
“We are investigating the leak of the documents,” Idrus said.
In the viral copy of the alleged internal memo, the IPIC (International Petroleum Investment Company) prosecution team was concerned that a strong prima facie case could not be built for the six charges.
The said case referred to the charges against the former prime minister and Irwan at the Kuala Lumpur Sessions Court on Oct 25, 2018, where the two were jointly charged with six charges under Section 409 of the Penal Code for breach of trust amounting to RM6.6bil in government funds involving payments to IPIC.
On Dec 7, 2018, the case was transferred to the High Court.
Nooryana said the alleged document revealed how the AGC’s own prosecution team had concluded that the six charges were “non-starters” and do not meet the minimum requirement or threshold to be brought to court.
Thomas had reportedly said he did not remember the purported memo but Nooryana dismissed his remarks, describing it as “a great insult to the public’s intelligence”.
Thomas, to whom the alleged leaked internal memo was made on Sept 10, 2019, said that he resigned from the post six months later without taking “a single file”.
“My resignation in Feb 2020 was unplanned and I left without taking a single file.
“Therefore, I cannot remember this at all as I do not have any access to any of the AGC files now,” he said.
