Company supervisor sentenced to 10 years’ jail, fined RM70,000 for DUI that led to death

MELAKA: An interior design company supervisor was sentenced to 10 years in jail and fined RM70,000, in default 12 months in jail, by an Ayer Keroh Magistrate’s Court here for driving under the influence of alcohol that resulted in a road crash and caused the death of a car driver, three years ago.

Magistrate AzureenSahira Sauffee Afandi meted out the sentence on Lee Han Wee, 45, after finding the defence had failed to raise reasonable doubt against the prosecution’s case on Friday (Sept 6).

The court also ordered Lee’s driving licence to be restrained for 10 years upon completing his jail sentence.

Lee was charged with driving a car under the influence of alcohol that resulted in a road crash and caused the death of Melaka Historic City Council (MBMB) employee Abdul Rahim Mohamad, 53, at Jalan Klebang here, at about 12.45am on Nov 29, 2021.

The charge was framed under Section 44(1)(a) of the Road Transport Act 1987 (Act 333/87), which carries a maximum of 15 years in prison, a fine of RM100,000 and disqualification from driving for 10 years, upon conviction.

Lawyer Alhirzan Mohd Akhir who represented Lee, applied for a stay of execution of the prison sentence by stating that his client required specialist treatment after sustaining a hip injury in the incident.

Deputy Public Prosecutor Sherina Farhana Nor Sa’ari objected to the request as Lee will be able to receive treatment in prison.

The court granted the stay and increased Lee’s bail to RM20,000 with one surety.
