High Court acquits man in 2020 Senai murder case
JOHOR BARU: The High Court here acquitted and discharged an unemployed man over a murder case in Senai five years ago.
S. Adinarayanan, 43, walked out a free man after Judge Kan Wen Hin found him not guilty of murdering T. Krishnan, 64, on Thursday (Nov 27).
According to the charge sheet, he was accused of causing the victim’s death at a house on Jalan Senai Jaya 6, Taman Senai Jaya, Kulai.
The alleged offence occurred between 1am and 8am on August 3, 2020.
He was charged under Section 302 of the Penal Code, which provides the death sentence or imprisonment between 30 and 40 years with at least 12 strokes.
The victim’s body was found inside the premises with severe head and body injuries.
In his judgment, Kan said the prosecution failed to prove the case beyond reasonable doubt.
“There is no proof linking the accused with the murder weapon, a piece of wood, as his DNA was not found on it,” he said.
Kan said one prosecution eyewitness had died, so the defence could not cross-examine his statement.
“This eyewitness said he could not clearly remember meeting the accused as he was intoxicated. With this in mind, I find the accused not guilty of murder and order him discharged and acquitted,” he added.
